1. About Pictoirel and the Legal Operator
Pictoirel is an online brand used for the sale of personalised photobooks and related memory products. Pictoirel is not currently a separately licensed legal entity. 2. Eligibility to Use the Website
By using this website, you confirm that you are at least 18 years old or otherwise have the legal capacity to enter into a binding contract in your jurisdiction. 3. Our Products and Personalised Nature of Orders
Pictoirel products are personalised and made to order using photographs, images, text, names, dates, captions, and other content uploaded, selected, or approved by the customer.
Because each product is personalised for the customer, orders may not be eligible for cancellation, refund, or exchange once production has started, except where required by applicable law or where the product is incorrect, damaged, defective, not delivered, or materially different from what was ordered due to an error on our side.
Product images, website previews, mock-ups, and promotional images are for illustration and guidance. Minor differences may occur due to screen brightness, image resolution, paper stock, printing process, cropping, bleed, binding, colour conversion, and production tolerances.
4. Customer Uploaded Content
You are responsible for all photographs, images, text, captions, names, dates, logos, designs, and other content that you upload or submit through the website.
By uploading content, you confirm that:
· you own the content or have permission from the owner to use it for the purpose of creating the personalised product;
· you have obtained any necessary consent from individuals shown in the photographs, including parents or guardians where minors are included;
· the content does not infringe copyright, trademark, privacy, publicity, image rights, or any other third-party rights;
· the content is not illegal, abusive, defamatory, obscene, exploitative, hateful, discriminatory, threatening, or otherwise unsuitable; and
· the content does not contain malware, viruses, corrupted files, or anything intended to interfere with our systems or website.
We do not claim ownership of your uploaded photographs or personal content. However, you grant us a limited, non-exclusive, royalty-free licence to access, process, store, resize, crop, arrange, preview, print, package, deliver, and otherwise use the uploaded content solely for the purpose of fulfilling your order, providing customer support, handling quality issues, and complying with legal obligations.
We may refuse, suspend, cancel, or delete an order or upload if we reasonably believe the content is unlawful, unsafe, infringing, abusive, or unsuitable for production. Where appropriate, we may issue a refund in accordance with our Refund and Reprint Policy, after deducting any costs already incurred where permitted by law.
5. Book Preview, Customer Approval, and Automated PDF Generation
When you upload your photographs, the website may generate a preview of the photobook before you place or complete your order. This preview is provided to help you review the general layout, sequence, design, and appearance of the book.
You are responsible for carefully checking the preview, uploaded images, spelling, captions, names, dates, sequence, orientation, cropping, image quality, and product selection before submitting your order.
We are not responsible for customer-side mistakes approved or submitted by the customer, including low-resolution images, blurry images, wrong image selection, wrong order sequence, spelling mistakes, incorrect names or dates, repeated images, poor cropping caused by the uploaded photo composition, or failure to review the preview before ordering.
6. Orders, Acceptance, and Refusal of Orders
Placing an order through the website is an offer to purchase the selected product. We may accept or reject an order at our discretion, including where payment is not authorised, product information is incorrect, production is not possible, uploaded content is unsuitable, there is a suspected fraud or misuse, or we are unable to deliver to the provided address.
An order is considered accepted only when we confirm the order and begin processing it, or when we otherwise indicate acceptance through the website or by email. We reserve the right to contact you for additional information where required to process or verify the order.
You must ensure that your contact details, delivery address, phone number, email address, and order information are accurate and complete. We are not responsible for failed delivery, delay, or loss caused by incorrect or incomplete information provided by you.
7. Prices, Payment, and Taxes
All prices displayed on the website are shown in the currency stated at checkout. Prices may change at any time without prior notice, but changes will not affect orders that have already been accepted unless there is an obvious pricing error.
The total amount payable, including product price, delivery charges, taxes, and any applicable fees, will be shown before checkout. Payment must be completed through the payment methods made available on the website.
We do not store full card details on our own systems. Payment processing may be handled by third-party payment service providers, subject to their own terms, security controls, and privacy practices.

8. Production, Printing, and Quality Tolerances
Pictoirel may use third-party printing, binding, packaging, logistics, or fulfilment partners to produce and deliver your order. By placing an order, you acknowledge that your uploaded content and order details may be shared with such partners strictly as necessary to fulfil the order.
Although we aim to provide a high-quality printed product, you acknowledge that personalised print products may have reasonable production tolerances, including minor colour variations, trimming variations, binding alignment differences, spine position variations, paper texture differences, or slight differences between the digital preview and physical print.
These minor production tolerances will not normally be treated as defects unless they materially affect the usability, quality, or appearance of the product beyond reasonable print industry expectations.
9. Delivery and Fulfilment
Delivery timelines displayed on the website are estimates only unless expressly stated as guaranteed. Timelines may vary due to order volume, printing schedules, customer-side delays, courier delays, public holidays, address issues, weather, customs or border controls if applicable, force majeure events, or other circumstances outside our reasonable control.
We may fulfil orders through direct courier delivery, delivery from the printer to us followed by customer dispatch, or through a third-party fulfilment company. The fulfilment model may change from time to time without affecting your statutory rights.
Risk of loss or damage passes in accordance with applicable law and the delivery arrangement used. If your order is marked as delivered but you have not received it, you must contact us promptly so that we can review the matter with the courier or fulfilment partner.
10. Cancellations and Order Changes
Because Pictoirel products are personalised and made to order, cancellations or changes may only be possible before production starts. Once the print-ready PDF has been generated, reviewed, sent to the printer, or production has otherwise started, we may be unable to cancel or change the order.
If you need to request a cancellation or change, contact us immediately at [Insert support email] with your order number. We will try to assist where reasonably possible, but we do not guarantee that changes can be made after order submission.
Approved cancellations, if any, will be processed in accordance with our Refund and Reprint Policy and applicable law.
11. Refunds, Reprints, Damaged Products, and Incorrect Orders
Refunds, reprints, replacements, damaged products, defective products, non-delivery, and incorrect orders are handled under our Refund and Reprint Policy and Incorrect Order Policy, which form part of these Terms.
In general, we may provide a reprint, replacement, full refund, or partial refund where required by applicable law or where the product arrives damaged, defective, materially incorrect, not delivered, or otherwise not supplied in accordance with the order due to an error on our side.
We may require evidence such as photographs, videos, packaging images, order number, delivery details, and a description of the issue before approving a refund, reprint, or replacement. You must notify us within the timeframe stated in the applicable policy.
We do not usually provide refunds, reprints, or replacements for customer-side mistakes, including mistakes made during upload, preview review, text entry, photo selection, or ordering, unless required by applicable law.
12. Incorrect Recipient and Privacy-Sensitive Orders
Because photobooks may contain personal photographs and private memories, you must notify us immediately if you receive an order that does not belong to you. You must not copy, publish, share, scan, distribute, upload, or otherwise misuse any photographs, personal information, or content belonging to another customer.
If you receive an incorrect order, we may request that you return it, securely dispose of it, or follow specific instructions from our customer support team. We may cover reasonable return shipping costs where applicable and where the incorrect delivery was not caused by information you provided.
Our liability for an incorrect order will be handled in accordance with our Incorrect Order Policy and applicable law.
13. Privacy and Data Protection
Your use of the website and our handling of personal data are governed by our Privacy Policy. Because our services involve uploaded photographs and order details, we may process personal data to create previews, generate print-ready files, fulfil orders, provide customer support, prevent fraud, handle complaints, maintain records, and comply with legal obligations.
We will take reasonable steps to protect customer content and personal data. However, no website, upload system, payment system, courier process, or electronic transmission is completely risk-free. You should only upload content that you are comfortable submitting for the purpose of producing and delivering your order.

14. Intellectual Property

You retain ownership of your own uploaded photographs and personal content, subject to the limited licence granted to us for order fulfilment and related purposes described in these Terms and our Privacy Policy.
15. Website Use and Prohibited Activities
You agree not to misuse the website or services. Prohibited activities include:
· using the website for unlawful, fraudulent, harmful, abusive, or unauthorised purposes;
· uploading content that violates another person’s rights or applicable law;
· attempting to interfere with the website, servers, payment systems, upload systems, or security controls;
· using automated scraping, bots, scripts, or similar tools without permission;
· attempting to obtain unauthorised access to another customer’s order, files, account, or data;
· copying or exploiting website content, templates, previews, or designs for commercial purposes; and
· submitting false information, fraudulent payments, chargebacks without basis, or misleading claims.
We may suspend or terminate access, cancel orders, remove content, or take other appropriate action if we reasonably believe these Terms have been violated.
16. Accuracy of Website Information
We try to keep product information, pricing, descriptions, images, delivery timelines, and availability accurate and up to date. However, errors may occur. We reserve the right to correct errors, update information, cancel orders affected by obvious mistakes, and change or discontinue products or services at any time, subject to applicable law.

To the maximum extent permitted by applicable law, our liability arising from or relating to the website, services, products, order, delivery, incorrect order, damaged product, defective product, or customer content is limited to the amount paid by you for the affected product or the provision of an appropriate replacement, reprint, repair, or refund, as applicable.
We are not liable for indirect, incidental, special, consequential, punitive, or economic losses, including loss of profit, loss of opportunity, loss of data, emotional distress, reputational harm, or other indirect losses, except where such limitation is not permitted by law.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable UAE law, including rights available to consumers under mandatory consumer protection legislation.
19. Indemnity
You agree to indemnify and hold harmless AymSecure Consulting, Pictoirel, and their owners, employees, contractors, suppliers, fulfilment partners, and service providers from any claims, losses, liabilities, damages, penalties, costs, or expenses arising from your uploaded content, breach of these Terms, violation of law, misuse of the website, infringement of third-party rights, or failure to obtain necessary consents for photographs or personal content you submit.
20. Force Majeure
We are not responsible for delay or failure to perform where caused by events outside our reasonable control, including but not limited to natural disasters, fires, floods, severe weather, power failures, internet outages, cyber incidents, supplier failures, courier disruptions, labour shortages, public holidays, pandemics, government restrictions, war, civil unrest, or other force majeure events.
21. Changes to Products, Services, and Terms
We may update, change, suspend, or discontinue any part of the website, product offering, pricing, delivery method, fulfilment model, or service at any time. We may also update these Terms by posting the revised version on the website.
The version of the Terms in effect at the time you place your order will generally apply to that order, unless changes are required by law or relate to operational, security, or fraud-prevention matters. 22. Termination or Suspension
