1. Important Notice And Acceptance Of Terms
These Terms and Conditions govern your use of the Pictoirel website, online store, and all related services offered within the United Arab Emirates. By accessing our website, browsing our products, uploading photographs, or placing an order with Pictoirel, you agree that you have read, understood, and accepted these Terms in full. If you do not agree with any part of these Terms, you must not use our website or services.
Pictoirel is a custom printing service that designs and produces premium photobooks using images and content supplied by customers. Because our products are created specifically for each individual customer, these Terms are designed to clearly define what you can expect from us, what we expect from you, and how we both reduce risk, misunderstandings, and legal disputes. Nothing in these Terms is intended to override any mandatory rights you may have under applicable law, but these Terms set out the basis on which we are willing to provide our services.
Please note that Pictoirel does not provide legal advice. This document is provided on a good faith, standard commercial basis and is not a substitute for legal review. If you require legal assurances, you should obtain independent legal advice in the United Arab Emirates.
2. Definitions
In this document, “Pictoirel”, “we”, “us”, and “our” refer to the owner and operator of the Pictoirel brand and online store. “Customer”, “you”, and “your” refer to any individual or legal entity accessing our website, uploading content, or placing an order. “Services” refers to all features, functionality, and offerings available through our website, including but not limited to custom photobook design and printing.
“Customer Content” refers to any photographs, images, graphics, text, captions, notes, or other material that you upload, transmit, or otherwise provide to Pictoirel for inclusion in a photobook or for any related purpose. “Order” refers to a confirmed request placed by you through our website for one or more of our products or services. “Product” refers specifically to a printed, customized photobook or any other physical item that we may offer from time to time.
3. Eligibility To Use The Service
By using our website and placing an order, you confirm that you are at least eighteen years old and capable of entering into a legally binding agreement. If you are under eighteen, you may only use our Services under the supervision and explicit consent of a parent or legal guardian, and that parent or guardian must agree to these Terms on your behalf. You also confirm that all information provided during checkout, including name, contact details, and delivery address, is accurate and truthful.
We reserve the right, at our sole discretion, to refuse service, cancel orders, restrict access to our website, or close accounts if we suspect that these conditions are not being met, or if we believe that our Services are being misused in any way.
4. Description Of Services
Pictoirel provides an online platform where customers can order premium photobooks. You select a product type and specifications (such as number of pages), provide personal photos and other content, and we design and print a physical photobook which is then delivered within the United Arab Emirates. Our Service is limited to the reception, processing, printing, and delivery of your customized photobook, and does not include long term storage of your photos or general backup services.
Because each photobook is made specifically from Customer Content, every order is unique and cannot be resold or reused. You acknowledge that the overall appearance of the final photobook depends heavily on the quality, resolution, composition, and suitability of the photos and content that you provide.
5. Customer Content, Ownership And Responsibility
When you upload or otherwise provide Customer Content to Pictoirel, you confirm and warrant that you either own that content outright or have obtained all necessary rights, licenses, and permissions to use it for the purposes of creating a photobook and for allowing us to handle it as described in these Terms. This includes, without limitation, permission from photographers, studios, agencies, and from any person whose image, likeness, or personal data appears in the content.
You accept full responsibility for the legality, appropriateness, and accuracy of all Customer Content. Pictoirel is not obligated to verify ownership or permissions, and you agree that you are solely liable for any claims, losses, or disputes arising from the content that you provide. By submitting Customer Content, you grant Pictoirel a limited, non exclusive, royalty free license to use, reproduce, modify for layout purposes, and print that content solely for the purpose of designing, producing, and, where necessary, reprinting your photobook. This license automatically ends once your photos and files are deleted from our systems in accordance with our retention policy.
6. Prohibited And Inappropriate Content
You agree that you will not upload, submit, or request printing of any content that is illegal, offensive, or inappropriate. This includes but is not limited to nude images, sexually explicit content, pornographic material, intimate images, or sexually suggestive imagery, whether involving adults or minors. Any form of content that sexualizes or exploits minors or depicts them in a compromising, unsafe, or inappropriate context is absolutely forbidden and will not be tolerated under any circumstance.
You further agree that you will not submit content that promotes violence, hate, discrimination, harassment, self harm, or any act that is contrary to public morality or public order in the United Arab Emirates. Content that insults religions, disrespects cultural norms, promotes illegal activity, or infringes the intellectual property rights of others is also strictly prohibited. This includes, for example, images taken by professional photographers without permission, screenshots from films or shows, images downloaded from the internet without license, or logos and trademarks used without authorization.
If we determine, in our sole discretion, that any Customer Content is nude, sexually explicit, abusive, illegal, or otherwise inappropriate, we reserve the right to immediately cancel the affected order. In such cases, we may choose to refund the order, refuse to provide any services in relation to that content, and prevent you from placing further orders. If the content appears illegal or particularly serious, including any form of exploitation of minors, we may also report the matter to law enforcement or relevant authorities as required by UAE law.
7. Right To Review, Refuse Or Cancel Orders
Pictoirel reserves the right, but not the obligation, to review Customer Content for compliance with these Terms. We may reject or cancel any order that we believe involves prohibited content, violates legal or moral standards, or exposes us to unacceptable risk. We may also cancel orders for operational reasons, technical errors, or if we suspect fraudulent activity.
If we cancel an order before production begins, we will normally refund any payment received for that order. If we cancel an order due to prohibited content such as nude or inappropriate photos, we may issue a refund but are not obliged to provide details beyond informing you that the order breaches our content standards. Our decision in such matters is final, and you agree that we shall not be liable to you or to any third party for any refusal, cancellation, or suspension of service arising from your breach of these Terms.
8. Handling, Storage And Deletion Of Customer Photos
Pictoirel understands that your photos are sensitive and personal. We treat them with confidentiality and restrict access to staff or trusted service providers who need to handle them in order to design, print, and fulfill your order. Your photos may be stored temporarily on secure Shopify infrastructure or on reputable third party cloud storage providers that we use internally. These providers are selected carefully, but we cannot guarantee their systems beyond what is reasonable for a small business.
We use your photos only for the limited purposes of receiving your order, arranging and designing layouts, printing and quality checking the photobook, and dealing with any necessary reprints or customer service issues linked to that order. We do not use your photos for marketing, social media, advertisements, or promotional materials unless you give us explicit written consent for a specific purpose.
We do not keep your photos permanently. Our general policy is to retain Customer Content only for as long as is reasonably required to complete production and to handle any follow up issues such as damaged deliveries or reprints. As a guideline, we aim to delete or permanently discard Customer Content within a period of approximately thirty to sixty days after successful delivery of the order. In some cases we may delete earlier, for example if you request immediate deletion, or later where necessary to resolve disputes, comply with legal obligations, or deal with suspected fraud. Once the retention period has passed, we permanently delete your images from our working folders and systems, and clear them from trash or recycle areas so that they cannot be recovered. Pictoirel is not responsible if you fail to keep your own backup copies of your images, and we do not provide any data recovery service once content has been deleted.
9. Personal Data And Privacy
In addition to Customer Content, Pictoirel collects certain personal information that you provide during checkout, including your name, email address, phone number, delivery address, and order details. This information is used to process and fulfill your order, to contact you about your order status, to handle customer service inquiries, and to comply with legal, tax, and accounting requirements in the United Arab Emirates.
We do not sell your personal information to third parties. We may, however, share limited personal data with trusted third parties that assist us in operating our business, such as payment processors, delivery companies, and hosting providers. These parties are only given the data necessary to perform their specific function and are expected to handle it securely. By using our Services, you consent to this processing of your personal information. A more detailed explanation of how we handle personal data may be set out in a separate Privacy Policy, which should be read together with these Terms.
10. Ordering, Pricing And Payment
When you place an order on our website, you are making an offer to purchase a Product in accordance with these Terms. We reserve the right to accept or reject any order at our discretion. An order is accepted when we begin processing it or otherwise confirm acceptance in writing. All prices listed on the website are in UAE Dirhams and may be changed at any time. Price changes do not affect orders that have already been placed and confirmed.
Payment is typically required in full at the time of ordering. We use third party payment gateways integrated with Shopify to handle payments securely. Pictoirel does not store or have direct access to your full card details. If a payment is reversed, declined, or charged back after your order has been produced, we may seek to recover our costs and may also refuse to fulfill future orders from you.
11. Production, Print Quality And Layout
By submitting an order, you authorize Pictoirel to arrange and design the layout of your photobook using your photos and any text you provide, applying our professional judgment regarding placement, cropping, and sequencing. While we aim to respect any special requests, final design decisions may be made by our team to ensure print and binding compatibility.
You acknowledge that printed colors may differ slightly from what you see on your phone or computer screen due to differences in screen calibration, device brightness, and printing processes. You also acknowledge that low resolution or heavily compressed photos may appear blurred, pixelated, or grainy in print, and that screenshots, heavily edited images, or poorly lit photos may not produce ideal results. Pictoirel is not responsible for issues that arise due to the inherent quality of the images provided by you.
12. Delivery, Shipping And Risk
We will use reasonable efforts to produce and dispatch your photobook within the estimated timeframe indicated on our website or communicated during ordering. However, all production and delivery times are estimates and not guarantees. Delays may occur due to high order volumes, supplier issues, courier delays, customs or government checks, extreme weather, public holidays, or other factors beyond our reasonable control.
Delivery is usually handled by third party courier or postal services. The risk of loss or damage to the Product passes to you upon delivery to your specified address, or upon attempted delivery in circumstances where you are not available to receive the product. It is your responsibility to provide a correct and complete delivery address. If the address is incorrect or incomplete, we may not be able to deliver, and you may incur additional charges for re delivery.
If your order arrives with visible damage or defects, you should notify us as soon as possible, ideally within forty eight hours of receipt, and provide clear photographic evidence of the issues. We will review the matter and, if appropriate, arrange a reprint or replacement at our discretion.
13. Returns, Cancellations And Refunds
Because our photobooks are custom made and personalized with your photos, they cannot be resold or reused. For this reason, we do not generally accept returns or provide refunds for change of mind, for subjective dissatisfaction with layout that was not specified in advance, or for issues arising from low quality images supplied by you.
You may request cancellation of an order shortly after placing it. However, if production has already begun, we may be unable to cancel, or may only do so on a case by case basis. If we are able to cancel before work starts, we may offer a refund. If we must cancel an order because the content is nude, offensive, or otherwise prohibited under these Terms, we may choose to refund the purchase amount but are not obligated to provide any compensation beyond a refund.
Where there is a clear manufacturing defect, printing error that is our fault, or significant damage in transit, we will normally offer a reprint or replacement photobook. The decision to offer a refund instead of a reprint may depend on the circumstances and remains at our discretion.
14. Limitation Of Liability
To the maximum extent permitted by applicable law in the United Arab Emirates, Pictoirel is not liable for any indirect, incidental, special, or consequential losses or damages arising out of or in connection with the use of our Services. This includes, without limitation, loss of data, loss of digital photos, emotional distress, missed events, reputational harm, or any costs associated with re creating images or memories.
In all cases, the total aggregate liability of Pictoirel to you for any claim, whether in contract, tort, or otherwise, shall not exceed the total amount actually paid by you for the specific order giving rise to the claim. This limitation applies even if Pictoirel has been advised of the possibility of such damages, and even where remedies fail in their essential purpose.
Nothing in these Terms is intended to exclude or limit any liability that cannot be excluded or limited under applicable law, such as liability for fraud or fraudulent misrepresentation.
15. Indemnity
You agree to indemnify, defend, and hold harmless Pictoirel, its owners, employees, partners, and representatives from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your breach of these Terms, your misuse of the Services, your submission of Customer Content, or your violation of any law or the rights of a third party.
This obligation extends in particular to claims that Customer Content infringes copyright or other intellectual property rights, violates privacy or publicity rights, or constitutes defamation or other unlawful content. You agree that you will bear any costs, including legal expenses, arising from such claims and that you will cooperate fully in the defense of any matter for which you are responsible.
16. Intellectual Property In The Website And Brand
All branding, logos, trademarks, website design, text, graphics, and other content created by or for Pictoirel in connection with our Services are the exclusive property of Pictoirel or its licensors. You may not reproduce, distribute, modify, or use any of these materials for commercial purposes without our prior written consent.
You retain ownership of your original photos and Customer Content. Pictoirel does not claim ownership of your photos. However, by uploading or submitting them, you grant us the limited license described earlier to use them for the purpose of fulfilling your order and managing the customer relationship associated with that order.
17. Third Party Services And Links
Our website and order process may rely on third party services such as payment gateways, hosting providers, cloud storage services, analytics tools, and courier companies. These third parties may have their own terms and privacy policies, and your use of their services may be subject to those terms. Pictoirel is not responsible for the actions, policies, or failures of third party providers, although we endeavor to select reputable and secure partners.
Our website may also contain links to external websites or resources. These links are provided for convenience only. Pictoirel does not endorse and is not responsible for the content, security, or practices of third party websites.
18. Changes To Terms And Service
Pictoirel reserves the right to update, amend, or replace these Terms at any time. When we do so, we will update the “Last updated” date at the top of this page. It is your responsibility to review these Terms periodically. Your continued use of the website or Services after any changes have been made constitutes your acceptance of the revised Terms.
We may also change, suspend, or discontinue any part of our Services at any time, including the availability of products, features, or content. Wherever possible, we will provide reasonable notice of significant changes, but we are not obligated to maintain any particular service or feature.
19. Governing Law And Dispute Resolution
These Terms, and any dispute or claim arising out of or in connection with them or with the use of our Services, are governed by the laws of the United Arab Emirates. In the event of a dispute, we encourage you to contact us first so that we may attempt to resolve the matter amicably. If a resolution cannot be reached through discussion, the dispute shall be subject to the jurisdiction of the competent courts or authorities in the United Arab Emirates, unless otherwise required by mandatory law.
